Misteguay Creek Inter-county Drain Board meets July 10

Settlement agreement to be considered

The Misteguay Creek Inter-County Drain Board will hold a meeting at the Genesee County Drain Office at 9 a.m., on Tuesday, July 10. The meeting is open to the public.

During the meeting, Saginaw County Public Works Commissioner Brian Wendling will present a proposed settlement agreement concerning the Albee Township vs. Misteguay lawsuit. The drain board is expected to vote on the proposed agreement.

In other business, the board is expected to take action on making a one-year extension on the $800,000 bank note through Chemical Bank, as well as authorize payment on properly presented invoices, vouchers and drain orders.

In 2010, Albee Township petitioned the Misteguay Creek Inter-county Drain Board to make improvements to the lower part of the drain, which is located within Saginaw County.

If approved, the cost would be distributed to properties in northern Shiawassee County, southeast Saginaw County and western Montrose Township in Genesee County. People have disputed the size and scope of the project primarily due to the initial cost estimate ranging from $6 to $9 million, which would hit farmers the hardest, since they own the most land.

Those in opposition have proposed scaling back the size of the project, although Albee Township farm owners have been pushing for the full-scale project.

The initial project called for the maintenance or improvement of approximately 20 miles of county drain, approximately 20 miles that are not county drain dikes, approximately 22 miles of dams and three flood control structures.

In April of this year, Judge Janet M. Boes dismissed both opposing lawsuits.

Once the Misteguay Inter-county Drainage Board resolves the issues, work on the project is expected to commence. However, with the many project delays, the cost will likely have to be reevaluated.
